terms and CONDITIONS
1. General Information
By becoming a member of Physique Fitness or using our facilities, you agree to comply with the following terms and conditions. These rules are in place to ensure a safe, respectful, and enjoyable environment for all members and guests.
2. Membership Eligibility
2.1. Individuals aged 17 and under may join with parental consent and approval from gym management.
2.2. Members are required to complete and sign a membership application, provide accurate personal information, and agree to all terms set forth herein.
3. Membership Fees and Payments
3.1. All membership fees are payable in advance, either monthly or annually, as agreed upon at the time of joining.
3.2. Physique Fitness reserves the right to change membership fees at any time, with prior notice to members. Any changes will apply only to future payments, not current agreements.
3.3. All payments are non-refundable, except where explicitly stated in the cancellation terms.
4. Membership Cancellation
4.1. Members on a direct debit monthly plan agree to a minimum 12 month fixed term.
4.2. Cancellations within the first 7 days of joining will be eligible for a full refund, provided no facilities were used.
4.3. Physique Fitness reserves the right to terminate or suspend a membership for failure to adhere to these terms, for non-payment, or for inappropriate behaviour, with no refund of fees.
5. Facility Access and Use
5.1. Members must check in at the front desk with a valid membership upon entering the facility.
5.2. Guests are allowed with prior arrangement and applicable guest fees. All guests must adhere to the same rules and regulations as members.
5.3. Gym facilities, including equipment, showers, locker rooms, and fitness classes, are available during designated hours. Physique Fitness reserves the right to change operating hours and will provide notice in such cases.
5.4. The gym equipment must be used appropriately and safely. Members must clean equipment after use and return weights to their proper place.
5.5. Locker use is provided as a courtesy during workouts. Physique Fitness is not responsible for lost, stolen, or damaged personal items.
6. Code of Conduct
6.1. All members are expected to treat gym staff, trainers, and fellow members with respect and courtesy.
6.2. Harassment, discrimination, or offensive behavior will not be tolerated and may result in membership suspension or termination.
6.3. Proper gym attire, including closed-toe shoes, must be worn at all times.
6.4. Smoking, drug use, or alcohol consumption is strictly prohibited within the facility.
7. Personal Trainers and Classes
7.1. Only Physique Fitness authorised personal trainers may provide training or instruction within the facility. Members found engaging in unsanctioned training will be subject to termination of membership.
7.2. Fitness classes are available to members as part of their membership or for an additional fee, depending on membership type. Class schedules are subject to change, and advance sign-up may be required.
8. Health and Safety
8.1. Members with pre-existing medical conditions or injuries must consult their doctor before using the gym.
8.2. In the event of an emergency or accident, members must immediately notify gym staff.
8.3. The use of the gym is at the member’s own risk. Physique Fitness is not liable for any injury, accident, or health issues arising from gym use.
9. Privacy and Data Protection
9.1. Physique Fitness will collect and process personal information in accordance with applicable privacy laws.
9.2. Members agree that Physique Fitness may use their personal data for membership management, billing, and communication purposes.
9.3. Personal information will not be shared with third parties without member consent, except as required by law.
10. Changes to Terms and Conditions
10.1. Physique Fitness reserves the right to update or modify these terms and conditions at any time.
10.2. Any changes will be communicated to members via email or posted on the gym’s website. Continued use of the gym facilities after changes are made constitutes acceptance of the revised terms.
11. Liability Waiver
11.1. Physique Fitness and its staff shall not be liable for any loss, injury, or damage to persons or property arising from the use of the facilities.
11.2. Members acknowledge that the use of gym equipment, facilities, and participation in any activities, including classes, is voluntary and entirely at their own risk.
12. Governing Law
These terms and conditions shall be governed by and construed in accordance with English Law. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England.
